SCOVR! These Terms and Conditions (
“Terms”) govern your access to and use of the
SCOVR mobile application, website (scovr.com), and any related services (collectively, the
“Service”).
SCOVR is operated by
AMVLET Technologies Ltd., a company registered in the Republic of Seychelles.
SCOVR™ is a networking platform. By downloading, accessing, or using
SCOVR, you agree to comply with and be bound by these Terms. If you
do not agree with any part of these Terms, you must not use the Service.
Additional Policies
Please review our
Privacy Policy (above or linked on our website), which is incorporated into these Terms by reference. The Privacy Policy explains how we collect and handle your personal data when you use
SCOVR. By using the Service, you also consent to the practices outlined in the Privacy Policy. We may update these Terms from time to time. If we make material changes, we will notify users by posting the revised Terms on our website or in the app and updating the “Last Updated” date. Continuing to use the Service after changes are posted will signify your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.
Eligibility and Account Registration
You must be at least
13+ years old to create a
SCOVR account or use the Service. By using
SCOVR ID, you represent and warrant that you meet this age requirement and that you have the full right, power, and authority to enter into these Terms. We do not knowingly allow minors to use
SCOVR, and any misrepresentation of age will be considered a breach of these Terms.
Account Creation
To access certain features of
SCOVR (such as participating in the social network or connecting with other users), you will need to create an account (your
SCOVR ID). When creating an account, you agree to provide accurate, current, and complete information about yourself as prompted by the registration process. This typically includes providing your first name, a valid email address, and creating a secure password. You
must not impersonate anyone or use a name or username that is offensive or violates any third-party rights.
Account Security
You are responsible for maintaining the
confidentiality of your account login credentials. Do not share your password with others. You agree to notify us immediately at hi [at] scovr [dot] com if you suspect any unauthorised access to or use of your account. You are responsible for all activities that occur under your account, whether you know about them. We encourage you to use a strong, unique password and to log out from your account at the end of each session on a shared device.
Account Usage
Each user may only create
one account for their personal use. You may not transfer or assign your account to someone else. We reserve the right to refuse registration, cancel an account, or reclaim usernames (e.g., if they violate someone’s intellectual property or impersonate someone).
Freemium and Paid Services
SCOVR is offered on a “freemium” model for consumers. This means core features of the Service are free for personal use, while certain premium features or advanced services may be offered for a fee (
“Paid Services”). Paid Services, like
.PLUS are intended for individual consumers only.
Free Version
As a standard user, you can use
SCOVR basic features to connect with others at no cost. The free version may have certain limitations (for example, limited number of new connections per day or no big data hosting included).
Paid Version (.PLUS Features)
We may offer optional subscription plans or one-time purchase features for a fee (for example, a premium tier that unlocks additional functionality, broader networking capabilities). The details of any Paid Services, including pricing, features, and payment terms, will be provided to you within our platform by the time you choose to subscribe. By electing to use a Paid Service, you agree to pay the applicable fees and to any additional terms presented to you at the time of purchase.
Payment and Billing
Paid Services might be billed on a subscription basis (e.g., monthly or annually) or as one-time fees, depending on the offering. Prices are stated in the app or on our site, and we reserve the right to change the fees or introduce new fees with reasonable notice. If subscription-based, your payment method (e.g., credit card) will be charged at the beginning of each billing cycle. It is your responsibility to ensure that your billing information is accurate and up-to-date.
Trials and Promotions
SCOVR may occasionally offer free trials or promotional offers for Paid Services. Such offers are subject to these Terms and any additional terms of the promotion. We reserve the right to modify or terminate trials and promotions at any time, as appropriate.
Refunds and Cancellations
If you purchase a Paid Service through an app store (such as Apple App Store or Google Play), the cancellation and refund policies of that platform will apply. Generally, subscription cancellations will take effect at the next billing cycle – you will retain access to premium features until the end of the period you’ve paid for, but no further charges will be made. We will not provide refunds for partial periods or unused features except as required by law or the terms of the app store. If you believe you have been charged in error, please contact us or the platform from which you made the purchase to discuss the issue.We aim to be clear about any fees before you incur them. If you require any further assistance about what is free and what is paid, please review the information in the app or contact our support.
Acceptable Use of SCOVR
We want
SCOVR to be a safe and positive community. By using the Service, you agree to the following rules of acceptable use.
You must not Violate Laws
Use
SCOVR for any purpose that is illegal or prohibited by law. You agree to comply with all applicable laws and regulations in your jurisdiction while using the Service. This includes not using the Service to commit any unlawful act, not engaging in fraud, and not violating privacy or intellectual property rights of others.
Infringe Rights
Post or share any content on
SCOVR that infringes or violates the rights of others, including intellectual property rights (such as copyright or trademarks) or privacy/publicity rights. Only upload photos, messages, or other content that you have the right to share.
Harass or Harm Others
Use
SCOVR to upload, post, or transmit any defamatory content, harassing, threatening, abusive, obscene,
pornographic, or otherwise objectionable. Hate speech, bullying, and discrimination of any kind (based on race, religion, gender, sexual orientation, etc.) are strictly forbidden. You also agree not to stalk, intimidate, or harm another person via the Service.
Impersonation and Misrepresentation
Impersonate any person or entity, or falsely state or misrepresent yourself (including your identity, age, or affiliations). You should not create accounts for anyone apart from yourself (except in cases such as a guardian managing an account with proper consent, if that scenario is ever supported).
Spam and Unsolicited Messages
Upload or send any unsolicited or unauthorized advertising or promotional content, junk mail, spam, pyramid schemes, or any other form of solicitation through
SCOVR. You may not use
SCOVR to harvest contact information of other users for the purpose of sending spam.
Interfere with Service Integrity
Engage in any activity that could damage, disable, overburden, or impair the proper working of
SCOVR. This includes not attempting to interfere with or disrupt the Service, servers, or networks connected to the Service (for example, by transmitting worms, viruses, malware, or any code of a destructive nature). You also agree not to bypass any measures we may use to prevent or restrict access to certain features or enforce limitations.
Reverse Engineer or Misuse
You must not attempt to reverse engineer, decompile, or extract the source code of our software, except to the extent allowed by law. Furthermore, do not use any automated means (such as bots or scripts) to access or collect data from
SCOVR without our permission. Scraping the Service or trying to mass-collect user data is prohibited.
Commercial Use without Consent
You may not use the Service for any commercial purpose not expressly approved by
SCOVR. This means you shouldn’t be running advertisements, promotions, or offering to sell any products or services to other users through
SCOVR, unless you have our written consent (for example, an official partnership). Violation of these rules may result in immediate termination or suspension of your account and access to the Service, as well as potential legal consequences. We reserve the right (but not the obligation) to investigate and take appropriate action against anyone who, in our judgment, violates these rules, including removing offending content, reporting you to law enforcement authorities, or pursuing legal remedies.
User Content and Conduct
SCOVR may allow you and other users to create, post, store, and share content, including messages, text, photos, videos, or other materials (
“User Content”). You retain any intellectual property rights that you hold in the content you post. However, by submitting or posting User Content on
SCOVR, you grant
AMVLET Technologies Ltd. a worldwide, royalty-free, sublicensable, and transferable licence to host, store, use, display, reproduce, modify (for technical purposes, e.g., making sure content fits on a screen). Create derivative works of, publish, and distribute your User Content for the purposes of operating, developing, providing, and using the
SCOVR Service. This licence is for the limited purpose of operating and improving the Service and does not grant us any ownership over your content. We do not claim any ownership of your content.You represent and warrant that you have all necessary rights to the User Content you post, that our use of your content as permitted by these Terms will not infringe any third-party rights, and that your content complies with these Terms (especially the Acceptable Use rules above).
Content Moderation
We do not pre-screen all User Content, but
we reserve the right (but have no obligation) to review, monitor, and moderate content posted to the Service.
SCOVR may remove or disable access to any User Content that we deem, in our sole discretion, to be objectionable or in violation of these Terms or applicable law. We may also terminate or suspend accounts associated with such content. However, the presence of any content on
SCOVR does not imply our endorsement of it, and we are not responsible for any user-posted content.Users are encouraged to report any content or behaviour that violates these Terms or appears inappropriate. We will make a good-faith effort to review reports and take necessary action as soon as reasonably possible.
Interactions with Others
You are solely responsible for your interactions with other
SCOVR users, whether online or in person.
SCOVR is designed to facilitate
real-life meetings for friendship. While we strive to create a safe environment through features and community guidelines, we cannot guarantee the conduct of any user. Please exercise common sense and caution in your interactions. For example, do not share sensitive personal information with strangers, and when meeting someone in person for the first time, consider doing so in a public place and letting a friend or family member know where you are.
SCOVR is not responsible for the behaviour of any user, either online or offline. We do not conduct criminal background checks or screenings of our users at this time, so use your best judgment in deciding whom to meet or trust.
Intellectual Property Rights
SCOVR and all content and materials provided through the Service (excluding User Content, which is addressed above), including but not limited to the software, design, text, images, graphics, logos, trademarks, button icons, videos, and other content, are owned by or licensed to
AMVLET Technologies Ltd. and are protected by copyright, trademark, and other intellectual property laws. All
SCOVR trademarks, logos, and service names are trademarks of
AMVLET Technologies Ltd. (the “
SCOVR Marks”). You are not entitled to use any of the
SCOVR Marks without our prior written consent. Unauthorised use of our trademarks or any content on the Service may violate the law.
Limited Licence
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable,
revocable licence to access and use the Service and any content made available through the Service for your
personal, non-commercial use only. This licence is provided solely for you to enjoy
SCOVR as intended by us under these Terms. You may not copy, reproduce, modify, create derivative works from, publicly display, publish, transmit, or distribute any content from
SCOVR (apart from your User Content) without our prior written consent. You also may not reverse-engineer, decompile, or attempt to extract the source code of our software, except as permitted by law.
Third-Party IP
Some content or features on
SCOVR may include or rely on third-party materials (for example, software libraries, open-source components, or content provided by other users or partners). All third-party materials are the property of their respective owners. Your use of those materials may be subject to additional terms from those third parties.If you believe that any content on
SCOVR infringes your copyright or other intellectual property rights, please notify us promptly via hi [at] scovr [dot] com with details of the infringement claim. We respect intellectual property rights and will respond to valid notices of infringement (such as DMCA takedown notices, if applicable) by removing or disabling access to the offending content and terminating repeat infringers’ accounts when appropriate.
Disclaimers of Warranties
SCOVR provides a platform to connect with others, but we
cannot guarantee any specific outcomes from using the Service (such as finding friends or personal improvement).
Your use of the Service is at your sole risk. The Service is provided on an
“AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law,
AMVLET Technologies Ltd. and its affiliates, licensors, and partners expressly disclaim all warranties, conditions, and representations of any kind, whether express, implied, or statutory, including but not limited to
implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
(a) the Service will meet your requirements or expectations;
(b) the Service will be uninterrupted, timely, secure, or error-free;
(c) the information or content provided on the Service (including any recommendations or “emotional AI” driven suggestions) will be accurate, reliable, or correct;
(d) any defects or errors will be corrected; or
(e) that the Service will be free of viruses or other harmful components.
No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly stated in these Terms. For example, while
SCOVR may provide suggestions or prompts for meeting people, we make no guarantee that these suggestions will lead to successful friendships or that every interaction will be safe or positive. Users are diverse, and outcomes will vary. You are responsible for your own decisions and actions within the Service and in any offline interactions that result.Some jurisdictions do not allow the exclusion of certain warranties or the limitation of implied warranties. If these laws apply to you, some or all of the above disclaimers may not apply to you, and you may have additional rights.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall
AMVLET Technologies Ltd., its directors, officers, employees, agents, partners, or licensors, be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to:
(a) your use of or inability to use the Service;
(b) any conduct or content of any user or third party on the Service (including offensive, defamatory, or illegal conduct of other users);
(c) any content obtained from the Service; or
(d) unauthorized access, use, or alteration of your transmissions or content. This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether we have been informed of the possibility of such damage.In particular,
SCOVR (
AMVLET Technologies Ltd.)
will not be liable for any acts or omissions of other users you interact with, whether those occur on the platform or in real life. We also shall not be liable for any emotional distress or discomfort arising from communications or meetings arranged through
SCOVR. You understand that we are providing a platform and are not responsible for what each user does or says.
Cap on Liability
To the extent that our liability is not entirely excluded, the total liability of
AMVLET Technologies Ltd. for any claim arising out of or relating to these Terms or the Service, regardless of the form of the action, shall not exceed the amount you have paid to us for the use of the Service or, if you have not had any payment obligations, fifty U.S. dollars (USD $50).
Exceptions
Nothing in these Terms shall limit or exclude our liability for any liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by our gross negligence or intentional misconduct, or for fraud or fraudulent misrepresentation.Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, some of these limitations may not apply to you. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
Acknowledgment
You acknowledge and agree that the warranty disclaimers and liability limitations in these Terms are material bargained-for bases of this agreement, and that we have set our pricing and provided access to the Service in reliance on such disclaimers and limitations. Such disclaimers and limitations will apply even if any limited remedy fails of its essential purpose.
Indemnification
You agree to indemnify, defend, and hold harmless
AMVLET Technologies Ltd. (and its officers, directors, employees, and agents) from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) that arise out of or relate to:
(a) your use or misuse of the Service;
(b) your violation of these Terms or any applicable law or regulation;
(c) your violation of any rights of any third party (including other users), such as by infringement of intellectual property, or wrongful disclosure of confidential information or personal data; or
(d) any content that you post or transmit through the Service (including any claim that your content infringes or misappropriates any third party’s rights or has caused damage to a third party).
We reserve the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defence of such claims. You agree not to settle any such matter without the prior written consent of
AMVLET Technologies Ltd. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
Suspension and Termination
You are free to stop using
SCOVR at any time. If you wish to delete your account, you may do so through the app (if feature provided) or by contacting us at hi [at] scovr [dot] com. Closing your account will mean you can no longer access the Service or your content within it. Our handling of the data upon account deletion is described in our
Privacy Policy (generally, we delete or anonymise personal data except as legally required to retain).
Suspension or Termination by SCOVR
We reserve the right to suspend or terminate your access to the Service (or certain features of the Service) at any time, with or without notice, if we have reason to believe: (i) you have violated these Terms or any applicable law; (ii) you create risk or possible legal exposure for us; or (iii) our provision of the Service to you is no longer commercially viable or feasible. We will endeavour to notify you of the reason for termination or suspension, unless we are legally prevented from doing so or doing so could harm our rights or someone else’s rights.In the event of termination of your account due to a breach of Terms, you understand and agree that you may not be entitled to any refunds of paid fees (if any), and you may be barred from re-registering or using the Service in the future. We may delete your User Content associated with your account, or we may choose to retain it for a period for evidence purposes (at our discretion, in compliance with privacy laws).
Effect of Termination
Upon any termination of these Terms or your account, the following sections of these Terms will survive: Intellectual Property Rights (Section 6), Disclaimers (Section 7), Limitation of Liability (Section 8), Indemnification (Section 9), Governing Law (Section 12), and any other provisions that by their nature should survive termination. Termination of your access or account will not relieve you of any obligations that arose or accrued before the termination, or limit any liability you may have to
SCOVR or any third party.
Miscellaneous
These Terms (along with the Privacy Policy and any additional terms you agree to when using specific features) constitute the entire agreement between you and
AMVLET Technologies Ltd. concerning the Service. They supersede all prior or contemporaneous communications, whether electronic, oral or written, between you and us regarding the Service.
No Waiver
Our failure to insist upon or enforce any provision of these Terms is not to be interpreted as a waiver of that provision or right. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of
SCOVR.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then such provision will be severed from these Terms, and the remaining provisions will remain in full force and effect. The invalid provision will be deemed modified to the least degree necessary to remedy the invalidity while retaining the original intent.
Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law.
Third-Party Services
The Service may integrate with or allow you to use third-party services, such as signing in via an app store or sharing content through other platforms. Use of those third-party services is subject to their terms and privacy policies, and
SCOVR is not responsible for the actions or content of third-party services.
No Agency
No joint venture, partnership, employment, or agency relationship exists between you and
AMVLET Technologies Ltd. as a result of these Terms or your use of the Service. You do not have any authority of any kind to bind us in any respect.
Force Majeure
We will not be liable for any delay or failure in performance of any part of the Service, from any cause beyond our control. This includes acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labour, or materials.
Governing Law and Dispute Resolution
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Service or these Terms shall be governed by and construed in accordance with the laws of the
Republic of Seychelles. By using
SCOVR, you agree that any disputes will be resolved in accordance with Seychelles law.
Jurisdiction
You agree to submit to the exclusive jurisdiction of the courts of the Republic of Seychelles to resolve any lawsuit or proceeding arising out of or related to these Terms or the Service. We and you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
(This means you will not bring or participate in a class action lawsuit against us.)
International Use
We make no representations that the Service is appropriate or available in any particular location. Users who access or use the Service from jurisdictions outside Seychelles do so at their volition and are responsible for compliance with local law, if and to the extent local laws are applicable. You should not use the Service if you are in a country embargoed by Seychelles or under U.N. sanctions, or if you are on any restricted list.
